reported in Abu Dawood that the Prophet (Sallallahu Alaihi wa Sallam) recited Surah Zilzal in both Rak'ah of Fajr. Sheikh al-Albani graded it as Hasan.

Some scholars have said this only applies to prayers of a traveller - as it is well known that the traveller's prayer is meant to be of ease and concession. Some sahaba used to recite Falaq and Naas in Fajr when travelling.

But the fact that it's authentically narrated that he (peace be upon him) recited it proves that it's permissible.

The narrotor of the above hadith says he doesn't know if the prophet forgot or didi it purposefully. The normal case is that the Prophet's actions are to teach the ummah, so it wasnt out of forgetfulness. We have no reports that the sahaba corrected/inquired after salah, as they did when he peace be upon him) missed out a rakat.

What the imam said before salah : "...We will recite - inshaAllah - in both rakats Surah al-Zalzalah, following the action of the Prophet

he's acting upon the hadeeth:
أخرجه أبو داود في السنن رقم(816) فقال: حدثنا أحمد بن صالح حدثنا ابن وهب أخبرني عمرو عن ابن أبي هلال عن معاذ بن عبد الله الجهني أن رجلا من جهينة أخبره أنه سمع النبي صلى الله عليه وسلم يقرأ في الصبح إذا زلزلت الأرض في الركعتين كلتيهما فلا أدري أنسي رسول الله صلى الله عليه وسلم أم قرأ ذلك عمدا

Book 3, Number 0815:
Narrated Mu'adh ibn Abdullah al-Juhani:

A man of Juhaynah told him that he had heard the Prophet (peace_be_upon_him) reciting "When the earth is shaken" (Surah 99) in both rak'ahs of the morning prayer. But I do not know whether he had forgotten, or whether he recited it on purpose.
